Ukrainciaga operates this store and website, including all related information, content, features, tools, products, and services, to provide customers with a curated shopping experience (the “Services”). The Services are powered by Shopify.

This store is integrated with the Western Bid™ e-commerce platform. Western Bid, Inc. acts as the Merchant of Record and legal seller in purchase transactions completed through this store. Ukrainciaga remains responsible for the storefront, product information, order administration, fulfilment coordination, and customer support.

Product materials, fit, construction, measurements, and care instructions are provided on the relevant product page. Please review this information before placing an order.

Some products are made to order. Production may begin shortly after an order is accepted. Minor variations in colour, print placement, construction, measurements, or finish may occur as part of the production process and do not necessarily constitute a defect.

Where organic, recycled, or other certification information is provided, it applies only to the product, fabric, component, or blank product expressly identified on the relevant product page. A certification mentioned for one product should not be assumed to apply to other products or to the finished printed item unless expressly stated.

We reserve the right to modify product descriptions, discontinue products, or limit available quantities, geographic regions, or jurisdictions where reasonably necessary.

Nothing in these Terms excludes any product guarantee, warranty, remedy, or consumer right that cannot lawfully be excluded.

SECTION 3 — ORDERS

When you submit an order, you make an offer to purchase the selected products. Submission of an order does not by itself constitute acceptance.

An order is accepted only after the payment has been authorized and you receive an order confirmation or another express confirmation of acceptance. Ukrainciaga and Western Bid may decline, cancel, or place an order on hold where reasonably necessary, including because of product availability, pricing or listing errors, suspected fraud, payment issues, sanctions or legal restrictions, or an inability to deliver to the provided address.

If an order is declined, changed, or cancelled, we will make reasonable efforts to notify you using the contact details provided with the order. Any payment already collected for a cancelled order will be handled in accordance with the applicable payment and refund process.

Please review your order carefully before submitting it. Because some products are made to order and production may begin shortly after acceptance, we may be unable to cancel or modify an order after production has started.

Products purchased through the store are intended for personal or household use unless we expressly agree otherwise. You may not purchase products for unauthorized commercial resale or export.

SECTION 4 — PRICES, CURRENCIES, BILLING, AND PAYMENTS

Prices, discounts, and promotions may change without notice. The price applicable to an order is the price displayed at checkout when the order is submitted, subject to correction of obvious errors and applicable law.

Unless expressly stated otherwise, displayed product prices do not include shipping charges, customs duties, import taxes, or similar charges. Any charges collected through checkout will be shown before the order is submitted.

The store may display prices in different currencies for convenience. The final currency and amount presented at checkout govern the transaction. Your bank, card issuer, PayPal, or another payment provider may apply its own currency-conversion rate or additional fees. We do not control those rates or fees.

Western Bid, Inc. acts as the Merchant of Record for purchases made through this store. Western Bid enters into the sale transaction with the customer, receives payment, and is responsible for the payment transaction in its role as Merchant of Record.

SECTION 5 — SHIPPING AND DELIVERY

Some products are made to order. Production time is separate from shipping or transit time.

Production and delivery estimates are provided in good faith but are not guaranteed. Delivery may be affected by the production location, fulfilment partner, shipping carrier, customs processing, weather, security conditions, labour disruptions, or other events outside our reasonable control.

Products may be produced or fulfilled from different locations. An order containing multiple products may arrive in separate packages and at different times.

Tracking information will be provided where it is available. Tracking availability and the frequency of tracking updates depend on the carrier and destination.

We deliver to many international destinations, but availability may vary by product, carrier, destination, and applicable restrictions. We do not accept orders for delivery to Russia or Belarus.

You are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect, incomplete, refused, or undeliverable address may be charged to the customer where permitted by law.

Customs duties, import taxes, brokerage charges, and similar destination charges are the customer’s responsibility unless checkout expressly states that they are included.

The names, logos, designs, and slogans displayed through the Services belong to their respective owners and may not be used without authorization.

The Services may provide access to tools, features, integrations, or services supplied by third parties.

Third-party tools may be provided “as is” and “as available.” Your use of them may also be governed by the relevant third party’s terms and privacy policy.

SECTION 9 — RELATIONSHIP WITH SHOPIFY AND WESTERN BID

Ukrainciaga is powered by Shopify, which provides the technology used to operate and deliver the Services.

Shopify is not the seller or Merchant of Record for products purchased through this store. Shopify is not responsible for producing, fulfilling, shipping, returning, or supporting products purchased through the store.

Western Bid, Inc. operates the e-commerce platform through which payments are processed and acts as the Merchant of Record and legal seller in each completed purchase transaction.

Ukrainciaga operates the storefront and is responsible for product selection, product information, order administration, fulfilment coordination, delivery support, returns support, and direct customer communications.

To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for injury, loss, or damage resulting from products purchased through the store. Nothing in this section limits any right, remedy, or liability that cannot lawfully be excluded.

Termination does not affect any mandatory rights relating to an existing order.

This may include loss of profits, revenue, savings, data, business opportunity, or replacement costs, except where applicable law provides otherwise.

Nothing in these Terms excludes or limits liability for:

1. fraud or fraudulent misrepresentation;

2. death or personal injury caused by negligence where such liability cannot be excluded;

3. wilful misconduct or gross negligence where applicable;

4. breach of mandatory consumer rights;

5. defective, unsafe, or misdescribed products where applicable law imposes liability;

6. any other liability that cannot lawfully be excluded or limited.

Where liability may lawfully be limited but not excluded, it will be limited only to the extent permitted by applicable law.

SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify Ukrainciaga and its affiliates, partners, employees, contractors, licensors, and service providers against third-party claims, losses, or reasonable costs arising directly from:

1. your material breach of these Terms;

2. your unlawful use of the Services;

3. your infringement of another person’s rights.

This obligation does not apply to the extent that a claim results from our own breach, negligence, unlawful conduct, or responsibility that cannot be transferred to you under applicable law.

We will provide reasonable notice of an indemnifiable claim and reasonable opportunities to cooperate in its defence.

SECTION 19 — SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary.

The remaining provisions will continue in effect.

A failure or delay in enforcing a provision of these Terms does not waive the right to enforce it later.
